information concerning complaints, incidents, damages, deposits, refunds or insurance claims;
technical information, such as your IP address, browser type, device information, access times, referring pages and cookie identifiers; and
any other information you voluntarily provide in connection with your enquiry, booking or stay.
Please do not provide health information or other sensitive personal data unless it is necessary for us to respond to an accessibility or safety request.
If you provide personal data about another guest, you confirm that you are authorised to provide those details and that you have informed that person about this Privacy Policy. Each guest may also receive privacy information directly from us where required.
3. Why do we use your personal data and what is our legal basis?
We use personal data for the following purposes:
Managing enquiries, bookings and stays
We use your data to respond to enquiries, confirm and administer reservations, process payments, provide arrival and check-in information, communicate during your stay, arrange requested services and handle changes, cancellations, refunds, deposits, complaints or damages.
Legal basis: taking steps at your request before entering into a contract and performing the accommodation or booking contract.
Complying with Spanish guest-registration and other legal obligations
We process and disclose required guest, booking and stay information to the competent Spanish authorities and retain required records. We may also use data to comply with tax, accounting, consumer-protection and other legal obligations.
Legal basis: compliance with a legal obligation, including applicable Spanish accommodation and guest-registration legislation.
Protecting guests, properties and our business
We may process information to prevent fraud, maintain the security of accommodations and systems, establish or defend legal claims, collect outstanding amounts and investigate incidents or violations of applicable house rules.
Legal basis: our legitimate interests and those of the accommodation owner in protecting guests, property, systems and legal rights. Where required, the legal basis may instead be compliance with a legal obligation.
Operating and improving the website
We use necessary technical information to operate, secure and troubleshoot the website. With your consent, we may use analytics or similar non-essential cookies to understand website use and improve our services.
Legal basis: our legitimate interests for essential operation and security; your consent for non-essential cookies where consent is legally required.
Marketing communications
We will only send promotional emails or messages where we have a valid legal basis to do so. Where we rely on consent, you may withdraw it at any time by using the unsubscribe option or contacting us. Refusing or withdrawing marketing consent does not affect your booking.
Legal basis: your consent or, where permitted by law, our legitimate interests.
4. Is providing your data compulsory?
Certain identification, contact, booking and payment details are necessary to conclude and perform your booking. Spanish law also requires us to collect and communicate specified guest information. If you do not provide required information, we may be unable to accept or fulfil the booking or allow check-in.
Information requested solely for marketing or non-essential cookies is optional.
5. With whom do we share your personal data?
Where necessary for the purposes described above, we may share personal data with:
the owner of the accommodation you book;
Hostaway and providers supporting our booking website, property-management system, communications and hosting;
Stripe and other payment, banking, invoicing or fraud-prevention providers used for your transaction;
booking channels or travel platforms involved in a reservation;
service providers that assist with check-in, cleaning, maintenance, IT, professional advice or customer support, but only when they need the information to perform their services;
insurers, legal advisers, accountants, banks and public authorities where necessary; and
the Spanish Ministry of the Interior, law-enforcement bodies, courts, tax authorities or other competent authorities when required by law.
Our service providers may only process personal data in accordance with applicable data-protection requirements and their contractual or legal responsibilities. We do not sell your personal data.
6. International transfers
Some technology, booking, payment or communications providers may process personal data outside the European Economic Area. When this occurs, we use a lawful transfer mechanism, such as an adequacy decision adopted by the European Commission, approved Standard Contractual Clauses or another safeguard permitted by the GDPR. You may contact us for more information about the safeguards relevant to your data.
7. How long do we keep your personal data?
We retain personal data only for as long as necessary for the purposes for which it was collected and to comply with applicable legal obligations.
Spanish guest-registration records that we are legally required to maintain are kept for three years from the end of the contracted accommodation service, where that retention requirement applies to us.
Booking, contractual, payment, invoicing and accounting information is retained for the applicable statutory limitation and tax or accounting retention periods.
Enquiry and routine communication data is retained for as long as necessary to respond and deal with any follow-up, after which it is deleted or anonymised unless it forms part of a booking record or legal claim.
Information relating to complaints, incidents, damages or legal claims may be retained until the relevant limitation periods have expired and any proceedings have concluded.
Marketing data is kept until you withdraw your consent or object, unless we must retain limited information to record and respect your opt-out.
Cookie data is retained for the periods described in our Cookie Policy or consent tool.
When data is no longer required, it will be deleted, anonymised or securely restricted where continued storage is required by law.
8. Cookies
Our website may use cookies and similar technologies. Cookies that are strictly necessary may be used without consent to provide the booking website, remember essential choices, maintain security and process reservations. Analytics, advertising or other non-essential cookies will only be used where permitted and, when required, after you have given consent.
You can accept, refuse or adjust non-essential cookies through the cookie settings made available on the website. Further information, including the cookies used, their providers, purposes and retention periods, should be provided in our separate Cookie Policy or cookie-management panel.
9. Your data-protection rights
Subject to the conditions and exceptions in applicable law, you have the right to:
request access to your personal data;
request correction of inaccurate or incomplete data;
request deletion of your data;
request restriction of processing;
object to processing based on legitimate interests or to direct marketing;
receive certain data in a structured, commonly used and machine-readable format and request its transfer where applicable;
withdraw consent at any time, without affecting processing carried out lawfully before withdrawal; and
lodge a complaint with a supervisory authority.
To exercise your rights, email info@holihelpservice.com and state which right you wish to exercise. We may request reasonable information to verify your identity. Exercising your rights is normally free of charge.
You may lodge a complaint with the Agencia Española de Protección de Datos (AEPD) through https://www.aepd.es. You may also contact the competent data-protection authority in the EU or EEA country where you live or work.
10. Automated decision-making
We do not make decisions that produce legal or similarly significant effects on you solely through automated processing, unless we inform you separately and have a lawful basis to do so. Payment or fraud-prevention providers may perform their own automated checks in accordance with their privacy information.
11. Security
We use appropriate organisational and technical measures designed to protect personal data against unauthorised access, disclosure, alteration, loss or destruction. However, no online transmission or storage method can be guaranteed to be completely secure.
12. Children’s data
We do not knowingly allow minors to make bookings. The main guest making a reservation must meet the minimum booking age stated in our booking conditions. We may nevertheless be legally required to collect and report identification and stay information relating to accompanying minors. Such information must be provided by their parent, guardian or accompanying responsible adult.
13. Data obtained from other sources
We may receive personal data from the person making the booking, another member of the travel party, the accommodation owner, Hostaway, a booking platform, a payment provider or another party involved in administering the reservation. This may include identification, contact, booking, payment-status and communication information. We use this information for the purposes and on the legal bases described in this Privacy Policy.
14. Changes to this Privacy Policy
We may update this Privacy Policy when our services, providers or legal obligations change. The current version will be published on our website with its latest revision date. Material changes will be communicated where required by law.
